In addition, the Website forms (the contact form, the newsletter form and the Account deletion form) are protected by the Cloudflare Turnstile tool, provided by Cloudflare, Inc. Content entered in form fields is masked and is not transmitted to these tools. The Website also transmits to them information about events: sending the contact form (only the subject and type of matter), displaying the newsletter subscription pop-up, subscribing to the newsletter and clicking the App download button - without the name and surname, e-mail address or content of the message. The pages for confirming the Account and setting a new password for the App download the Supabase software library from the jsDelivr content delivery network (cdn.jsdelivr.net), which thereby receives the IP address and information about the browser.

This applies in particular to the providers of statistical tools (Google LLC and Microsoft Corporation, which participate in this framework), the provider of the infrastructure on which the database and forms of the Website run (Supabase Inc.), the provider of the e-mail delivery service (Resend) and the provider of the tool protecting forms against bots (Cloudflare, Inc.). If a provider does not participate in the EU-U.S. Data Privacy Framework, the transfer of data is based on standard contractual clauses adopted by the European Commission (Article 46(2)(c) GDPR).

3.The Controller provides the data subject with information on action taken on a request to exercise his or her rights relating to the processing of personal data without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity of the request or the number of requests. ANNEX NO. 2 TO THE TERMS OF SERVICE OF THE WEBSITE WWW.EQUIVO.PL

COOKIE POLICY

Pursuant to and in connection with Article 6(2) of the Polish Act of 18 July 2002 on the Provision of Electronic Services and Article 399(1) and (3) of the Polish Act of 12 July 2024 - Electronic Communications Law, the Service Provider provides information relating to the use of software which is not a component of the content of services provided by electronic means and which is introduced into the ICT system used by the User. This software consists of so-called cookies and similar technologies, including the browser's local storage (localStorage).

1.When accessing the Website for the first time, the User will be asked, through the Website's information banner entitled “We respect your privacy”, to consent to the installation and storage of cookies and to access to them. Until consent is given, the Website does not load statistical tools and does not connect to the servers of their providers.

2.Cookies are small files which are installed on the device of the User accessing the Website. The Service Provider uses cookies and similar technologies for the following purposes:

a.necessary cookies - a record of the User's choice regarding cookies (equivo_consent), stored in the browser's local storage (localStorage) for 12 months or until the rules on the use of cookies change. The record contains a random identifier, the date and the choice made, and is not used for tracking. The necessary category also includes the Cloudflare Turnstile tool (provider: Cloudflare, Inc.), which protects the Website forms against bots. It is activated only when the User starts filling in a form, may use browser storage and serves solely to distinguish humans from automated programs, and therefore does not require consent. The necessary category also includes remembering the decision concerning the newsletter subscription pop-up (equivo_newsletter_popup), stored in the browser's local storage (localStorage) for 30 days from closing the pop-up or for 12 months from subscribing to the newsletter. The record contains only the date and type of the decision and is not used for tracking. On the horse profile transfer page (equivo.pl/en/transfer), the transfer code (equivoHandoff), needed to open it in the App, is stored in the browser's session storage (sessionStorage); the browser deletes it when the tab is closed.

b.analytics cookies (in the settings window: “Statistics”) - used to collect information about how visitors use the Website. The data are collected by the Google Analytics and Microsoft Clarity tools and contain information such as the number of visitors to the site, the origin of visitors and the pages visited, and, in the case of Microsoft Clarity, also the course of the visit (clicks, scrolling, cursor movements) and heatmaps; content entered in form fields is masked. This information is then used by the providers of these tools to generate reports useful for managing and improving the Website. Google Analytics cookies (_ga, _ga_<identifier>) are stored for up to 2 years, and Microsoft Clarity cookies: _clck - for up to 1 year, _clsk - for up to 1 day. Microsoft Clarity may also store cookies on Microsoft domains (including CLID, MUID). The Service Provider does not use these tools for advertising purposes - Google signals and ads personalisation are disabled in Google Analytics.

3.The Website does not use functional, marketing or advertising cookies.

4.The User should read the information about cookies and decide whether to consent to the installation and storage of cookies and to access to them by clicking the relevant button among those displayed on the information banner, labelled:

a.“Accept” or equivalent words, which means that the User consents to the installation and storage of all of the Service Provider's cookies and to access to them.

b.“Decline” or equivalent words, which means that statistical cookies will not be installed or stored on the User's device.

c.“Settings” or equivalent words, which takes the banner to a screen on which the User can choose the types of cookies they accept. Two categories are available in the settings window: “Necessary” (always on) and “Statistics” (off by default), and the choice is confirmed with the “Save my choice”, “Decline” or “Accept” button.

5.The installation of cookies does not cause any configuration changes to the devices and software used by Users.

6.The Website uses both its own cookies, which are installed and accessed by the Service Provider, and third-party cookies used by the Service Provider's partners. Third-party cookies include analytics cookies (Google Analytics, Microsoft Clarity).

7.The cookie settings window indicates the statistical tools used: Google Analytics (provider: Google Ireland Limited) and Microsoft Clarity (provider: Microsoft Ireland Operations Limited). Data collected by these tools may be transferred to the USA under the EU-U.S. Data Privacy Framework. In the “Necessary” category, the window also indicates the Cloudflare Turnstile form protection.

8.Consent to the use of cookies is voluntary, except for necessary cookies, which are essential for the proper functioning of the Website. The User may withdraw consent at any time using the “Cookie settings” link in the Website footer. Withdrawal of consent results in the deletion of the statistical cookies stored on the Website's domain and in the Website being reloaded without the statistical tools. The Website asks for a choice again after 12 months and after any change in the rules on the use of cookies.

9.The User may determine the conditions for the storage of or access to cookies directly on the Website or by means of the browser settings. The use of cookies can also be limited by browsing the Website in incognito mode or by means of software specially installed for this purpose.

10.The User may delete cookies from his or her terminal equipment, in particular by using the “clear browsing data” function or a similar function available in the web browser settings.
